Regulatory Law

Hugh has extensive experience of prosecuting and defending regulatory offences in the criminal courts. Particular work includes:

  • Prosecuting and defending breaches of planning control, both in relation to enforcement notices and breach of condition notices, and dealing with public law defences to such prosecutions.
  • Confiscation proceedings under the Proceeds of Crime Act 2002. Hugh recently appeared on behalf of a local authority in a 3 day contested application for a confiscation order before the Crown Court, successfully obtaining an order in the sum of £36,000.
  • Prosecuting public sector housing offences, in particular fraudulent homelessness and benefits applications.
  • Education prosecutions for local authorities.
  • Appearing on PII applications on behalf of social services departments in criminal trials.
