Philip's planning work has included the following:

West Berkshire Core Strategy

Acting for Gerald Eve in legal challenge to Core Strategy, involving arguments on Strategic Environmental Assessment and public law principles.

Stop Linton Wind Farm

2010: acting for campaign group to prevent a wind farm in Cambridgeshire country-side. (Click here for news coverage of the decision)

Calderdale, Rossendale and Rochdale Councils

2009: instructed jointly by three councils in a five week, called in, conjoined three-site wind farm and common land deregistration inquiry, involving extensive technical evidence on landscape, transportation, noise, ecology, hydrology and hyrdro-geology.

Rochdale MBC

Instructed in various legal issues relating to Kingsway, a key regeneration site for the north west, comprising £300m+ of inward investment over 200 hectares, including important litigation regarding environmental assessment:

  • R v Rochdale MBC ex parte Tew: environmental assessment of outline schemes.
  • R v Rochdale MBC ex p. Milne: environmental assessment of outline schemes.
  • Legal issues regarding regeneration of Trans-PennineCanal, including successful CPO inquiries and general advice, including highways advice. Appeared in Lomax v SoS and Rochdale MBC: compulsory purchase procedures.

Sheffield City Council

  • Unitary Development Plan. Defeated practically all of over 600 objections.
  • Defeated appeal by Tesco to build superstore on sports field.
  • Various planning and highway JRs, CPOs and general issues.

North Yorkshire County Council

  • Acted for Council in House of Lords in R v North Yorkshire County Council ex parte Brown: environmental assessment and old mining permissions.

Tonbridge & Malling Borough Council

  • Compulsory Purchase of airspace above Port Authority and Railway land for construction of new road bridge.
  • Acting for Council in call-in inquiries regarding major housing sites.

Philip is personally committed to environmental issues and to community participation in the environment.

His work has included:

  • Co-author of the Environmental Law volume of Halsburys Laws (Butterworths 2000).
  • Author of Saving Open Space (GreenSpace), a community guide to campaigning to preserve green space from development.
  • Trustee of Campaign To Protect Rural England(2004-2007).
  • Chairman of Civic Trust (2007-2009).
