Challenge to Scarborough Casino decision fails

A challenge to Scarborough Borough Council’s Stage 1 casino licensing decision under the Gambling Act 2005 has been dismissed by District Judge Richard Blake at Scarborough Magistrates’ Court.

Nikolas Shaw Limited, who operate an existing casino in Scarborough, the Opera House, challenged the Council’s decision to make a provisional decision to grant to Apollo Resorts and Leisure Limited, who already operate the Open Air Theatre in Scarborough.

BBC News covers the decision against Serco, a sub-contractor to Birse Civils, in a case brought by the Health and Safety Executive following the death of Cecil Grant in an accident near Clevedon in January 2006.

Gerard Forlin QC represented Serco at the hearing: Serco accepting responsibility and pleading guilty at the earliest possible opportunity. Serco have put in place policies and procedures to ensure there will never be a repeat of such a tragic accident.

Revocation of nightclub licence

A Bristol nightclub, Panache, has lost its licence after its appeal against revocation was dismissed by Bristol Magistrates’ Court.

Bristol City Council revoked the licence following a Police application for review in October 2010. The club appealed the revocation and so were able to continue to trade pending the appeal. Then in April 2011 the Police applied for a summary review, following an incident in which a serious assault went unreported. This resulted in immediate closure of the premises. The licensee also appealed that decision and the two appeals were conjoined.

Judicial review challenges to the London Borough of Newham’s decision to grant a licence for a large casino have been withdrawn. The development clears the way for Aspers to open its casino within Westfield Stratford City – Europe’s largest shopping development – this autumn.
