It is well known that a large proportion of successful challenges to planning decisions have rested on the authority’s EIA failures. The need for, scope and adequacy of screening opinions, environmental statements and EIA applications are an essential consideration in many cases.
Members advise authorities and potential challengers to decisions, as well as developers on every aspect of Environmental Assessment – both the EIA of projects and the SEA of plans.
Members’ work includes
- the need for and adequacy of screening opinions;
- regulation 22 requests for additional information, on the conditions necessary to secure necessary compensation and mitigation;
- challenging and defending decisions on EIA grounds;
- advising on the strategic environmental assessment of a plans and programmes of all kinds.
