Judgment was given yesterday by the Supreme Court in R(SL) v Westminster City Council [2013] UKSC 27, writes Siân Davies
The case concerned an Iranian failed asylum seeker who received in-patient psychiatric care as he suffered from depression and post traumatic stress disorder. Upon discharge, he was assessed as independent in all self-care skills, with no cognitive or motor difficulties and was sociable and able to form positive relationships. SL did, however, need continuing supervision from a “care co-ordinator” who put in place links with counselling groups and regular meetings with a “befriender” which took place away from SL’s home.

ASBO clause can prohibit 'harassment, alarm and distress'

The Divisional Court has ruled that Anti-Social Behaviour Orders which contain a prohibition on causing ‘harassment, alarm and distress’ are lawful despite the decision in Heron v Plymouth City Council [20059] EWHC 3562 to the contrary.
The Council had made five ASBO applications in respect of youths who were engaging in Anti-Social Behaviour on their housing estate. The behaviour involved the youths congregating in a play area on the estate and causing nuisance and annoyance by riding on grassed areas with the mopeds and quad bikes.

Who is an Ordinary Homeless Person?

When determining who is in priority need for housing, local authorities must decide the difficult question of whether a person is more vulnerable than the “ordinary homeless person”: R v Camden LBC ex parte Pereira (1998) 31 HLR 317. For the first time, the Court of Appeal has given some guidance as to the characteristics of that mythical creature.
Craig Johnson applied to Solihull Metropolitan Borough Council as homeless and claimed to be in priority need as he was vulnerable: he was a recidivist offender, a recovering drug user and also claimed to suffer from depression and crippling knee pain. Solihull accepted that he used drugs, but felt that he could stay clear of them, but held that in any event, if he relapsed into drug use, this would not be unusual for a homeless person. He was not, therefore, more vulnerable than the ordinary homeless person.

In Ardagh Glass v Chester City Council [2009] EWHC 745, HHJ Mole QC (sitting as a High Court Judge) mooted the possibility that the time limits for enforcement in the Town and Country Planning Act 1990[1] may be incompatible with the EIA Directive[2], and may have to be disapplied so that EIA development could never become lawful without having first been subject to environmental assessment in accordance with the Directive.

Jon Holbrook of Cornerstone Barristers considers the profound effect that flexible tenancies could have on tenants of social housing. Flexible tenancies enable local authorities and housing associations to avoid granting tenancies for life.
OneLondonauthority, Barnet, has already drafted a tenancy strategy that explains how it proposes to secure a better match between housing needs and resources. This might mean, for example, that households with above median earnings in Barnet may not remain as council tenants.
With reforms of this kind landlords need to understand how the schemes are intended to work. Jon Holbrook’s two articles in the New Law Journal give guidance on the legal framework.

Local Government - the replacement standards regime

Chapter 7 of the Localism Act 2011 sweeps away the standards machinery put in place by the Local Government Act 2000 following Nolan and replaces it with a general duty to promote and maintain high standards of conduct, locally devised codes of conduct and local determination in relation to alleged breaches.
All relevant local authorities : "must promote and maintain high standards of conduct by members and co-opted members of the authority".

Assets of Community Value (ACV) are a creation of Chapter 3 of the Localism Act. What has driven the Government to legislate for them is not at all clear and the cases in which the new provisions will be of real practical value are likely to few in number. The reality is that they will encourage unrealistic and unrealisable local expectation to the detriment whilst imposing an unwelcome additional administrative burden on local authorities.

A new section 38A is inserted into the Town and Country Planning Act 1990 which allows any “qualifying body” to:
“initiate a process for the purpose of requiring a local planning authority in England to make a neighbourhood development plan”.
The draft NPPF advises that NDPs give communities direct power to plan the areas in which they live and they may be used to develop a shared vision for their neighbourhood and to set planning policies for the development and use of land. There are, however, restrictions.

Jon Holbrook recently grilled three independent social workers who gave evidence for the claimant, an Afghan asylum seeker, in an age assessment case.
They had sought to support the claimant’s claimed age of 16 whereas Solihull’s social workers had concluded that he was probably 20. In what is understood to have been the first fully contested age assessment case in the Upper Tribunal the Tribunal concluded in favour of Solihull.
