This case is now the leading case on the need for formality in determinations of certain planning applications. The decision of the House of Lords has had the effect of scrapping the application of the law of estoppel in planning cases (whilst discussing and enlarging the role of the parallel doctrine of legitimate expectation) and includes important dicta limiting jurisdiction of the courts in application for declarations.
