Appeals refused because of heritage harm to designated asset – Corn Hall Appeals

Tom Cosgrove KC appeared on behalf of Babergh District Council in successfully opposing two appeals (one seeking permission planning and one listed building consent) relating to a Grade II listed building known as Corn Hall. The case involved consideration of a full range of heritage issues including the exercise of the statutory duty under s66 of the LB Act 1990, the approach to the assessment of harm and a number of novel arguments concerning the planning history of nearby listed buildings and their relevance to the assessment of public benefits in undertaking an NPPF policy compliant heritage balance.
