Gerard Forlin KC is speaking at the IBA Annual Conference in Miami on the 3rd November 2022.
Gerard is speaking at the ‘Prosecution of employers for exposing workers to workplace stress and psychosocial risks’ session along with Christine Braamskamp of Jenner & Block, London, Domingos Fortunato from Mattos Filho, Brazil, and Hanim Hamzah from ZICO Law, Singapore. The session will be chaired by Patrick Benaroche of Stikeman Elliott, Canada and Bill Kritharas of Sparke Helmore Lawyers, Australia.
This session will look at the potential liability of employers, corporations and officers for breaching their duties to provide for the psychological safety of their workers and for exposing them to workplace stress. It will outline the new international standard ISO45003-2021 – Psychological Health & Safety at Work and will consider the investigation process where there has been an incident or complaint and what steps employers should be taking and the different approaches taken in different jurisdictions around the globe. The session will also look at recent coronial inquests involving workplace incidents which have increased with the recent pandemic where workers have been exposed to workplace stress at levels not previously seen. Gerard will speak on recent case law, ISO 45001 and 45003, and practical issues relating to Employer’s duties in this area. He will also discuss the recent important case of West Sussex [2022] EWHC 215 (QB) where he appeared in the Divisional Court on behalf of Families.
Gerard has spoken and worked in over 60 Countries and has been called to numerous Bars including Ireland (after passing the Irish Bar Examination in 2020), Australia and The BVI. He has spoken at numerous IBA conferences in the past including Seoul, Rome, Madrid and Vancouver.
