High Court appeal on one of the largest known tenancy deposit claims under the Housing Act 2004

21 Feb 2024

Today in Lowe v The Governors of Sutton’s Hospital in Charterhouse, the High Court will consider an appeal from the dismissal of one of the largest known tenancy deposit claims under Housing Act 2004.

Points of principles to be determined include whether section 9 Limitation Act 1980 applies to such claims (thus reducing the limitation period to 6 years from the right accruing) and the circumstances in which substantial compliance with the requirements under section 213(6)(a) may be satisfied. The outcome will be of interest to all landlord and tenant practitioners.

Shomik Datta represents the Respondent landlord, instructed by Antony Pidgeon of Stone King. News on the outcome will follow, when available.

Shomik is a property and commercial litigator with over two decades of experience. He is much in demand from an extensive client base that includes PLCs, SMEs, local authorities, registered providers, property developers, and high net-worth individuals.
