Lawful development certificate refused for extensive hardstanding next to industrial building

A commercial site in Elmbridge with a complicated planning history was said to benefit from permitted development rights under Class J, Part 7, Schedule 2 to the 2015 GPDO to construct a hardstanding within the curtilage of a building in B1/B8 use.

However, an inspector rejected an appeal against the refusal of a lawful development certificate on the grounds that the hardstanding that had been constructed went beyond the curtilage of the building and was not needed for the purpose of any undertaking carried on in the building. Robin appeared for the local planning authority.
