EA/2013/0162 – Damien Welfare represented LB Southwark (with Jack Parker) in a successful appeal against the decision of the Information Commissioner to order disclosure of a developer’s planning viability assessment. The main ground of exception was that concerning confidential commercial information under Reg 12(5)(e) of the Environmental Information Regulations (‘EIR’). The judgment also considered the general scope of the EIR, and its application to Planning. Appeal partially allowed.
