Lee Parkhill Represents Successful Defendant in a Judicial Review Challenge to NHS Care Provision

In R (Simpson) v NHS Mid and South Essex Integrated Care Board [2024] EWHC 3063 (Admin), the Claimant challenged the assessment of her needs and the provision of services as part of her package of NHS Continuing Healthcare. The Claimant challenged several aspects of her care provision, including the absence of funding for 24/7 nursing and the failure to fund office space to be used by her care team.

At a rolled-up hearing, Fordham J granted permission but dismissed the claim. The judgment helpfully demonstrates that the authorities addressing the Administrative Court’s approach to social care assessments apply equally to assessments of healthcare need by NHS bodies.
