Lisa acted for the claimant residents’ organisation in the first decided case concerning the provisions of the Town and Country Planning Act 1990 inserted by the Localism Act 2011 dealing with neighbourhood plans.
The case confirms that Local Planning Authorities have a broad discretion under section 61G of the 1990 Act as regards the designation of a specified area as a neighbourhood area on an application by a neighbourhood forum.
