250-Unit Housing Plan in Kent Sparks Inquiry on Flood Risk, Landscape Impact

This week Rowan Clapp appears on behalf of Swale Borough Council at a 6-day public inquiry concerning the refusal of permission for a 250-unit scheme outside the settlement boundary of Faversham, Kent.
The inquiry primarily concerns technical flood risk evidence, and the correct approach to flood risk management and the Sequential Test in light of the recent High Court decision in Mead Realisations v SSLHC [2024] EWHC 279 (Admin). The appeal also raises issues of local landscape harm, loss of best and most versatile agricultural land, and conflict with the Council’s settlement boundary policies.
