Court rejects claimant’s belated objection to distribution centre

In Wallis v North Northamptonshire Council, Mrs Justice Lang DBE has held that a claimant was too late to apply for a judicial review.

The claimant lived adjacent to a former Weetabix factory. The first interested party acquired the site and applied for planning permissions to demolish existing buildings and thereafter applied to construct a distribution centre. The council did not properly give notice to the claimant and other neighbouring residents.

Construction work started in May 2022 and was substantially completed by the date of the hearing in late 2024. The claimant learned of the development in January 2024 when the new building was being erected, and filed the claim for judicial review in April 2024.

Mrs Justice Lang DBE held the claimant was too late to apply for judicial review.
