Business and Property Masterclass #1: Mastering Disclosure in the Courts

Five years following the introduction of the disclosure pilot, the increasing practical and procedural complexities of disclosure in the Business and Property Courts continues to pose challenges to practitioners.  

This session will discuss common judicial case management approaches to disclosure and provide guidance on how to navigate the preparation of the Disclosure Review Document effectively, including via the use of practical examples.

Presenters:

Jack Barber specialises in planning, local government and public law. He is rated as one of the ‘top-rated junior barristers aged under 35’ (Planning Law Survey, 2024). He has appeared in the Court of Appeal, High Court and County Court, the First-tier Tribunal and in public inquiries and hearings. His wide client base includes local authorities, housing authorities, developers and local interest groups. Since November 2023, Jack has been registered with the Attorney General’s civil junior scheme.

Olivia Davies’ practice includes planning and environmental law, commercial law, public law and housing law. She regularly appears before courts, tribunals and public inquiries. Olivia’s public clients are often local authorities, whom Olivia represents in a range of cases, from a recent un-led two-week planning inquiry concerning the refusal of permission a 49.9MW solar development on Green Belt land, to complex multi-track possession trials. Olivia’s private advisory work benefits from her understanding of the needs of commercial clients gained through her time at Latham & Watkins LLP before coming to the Bar.
