On Thursday 13 January, the Court of Appeal decided, in London Borough of Barking and Dagenham and Others v Persons Unknown, London Gypsies and Travellers intervening [2022] EWCA Civ 13, not to follow its earlier decision in Canada Goose UK Retail Ltd v Persons Unknown [2020] 1 WLR 2802.

It has held that final precautionary injunctions may be granted against ‘newcomers’ and that the judge at first instance was wrong to hold otherwise.

Ranjit Bhose QC acted for some of the appellant authorities and Wayne Beglan acted for a local authority intervener.
