The claim was defended on public law grounds following the cases of Kay and others v Lambeth LBC [2006] 2 AC 465 and Doherty v Birmingham City Council [2008] UKHL 57 on the basis that the local authority failed to act proportionately in bringing the Defendant’s non-secure tenancy to an end. (County Court, Circuit Judge).

Ryan Kohli appeared on behalf of the local authority landlord in a claim for possession at trial.
