In the case of R (Lucchetti) v South Norfolk DC [2012] EWHC 3557 (Admin) the High Court ruled that the defendant local planning authority had not been entitled to impose conditions on the grant of prior approval under Part 6 Class A of Sch. 2 to the GPDO for an agricultural building except for those conditions contemplated by Part 6.
