01 Jan 2018
Public Law and Judicial Review
Election petition pursued by way of case stated. Estelle appeared for the Petitioner. The petition was eventually withdrawn and the Court clarified that the requirement in the Election Petition Rules 1960 r.12(3) that a notice to withdraw an election petition should contain a statement that on the hearing of the application any person who might have been a petitioner in respect of the election could apply to the court to be substituted as a petitioner had been impliedly repealed or should be disregarded.
