Ryan Kohli and Rowan Clapp appear in the Court of Appeal today on behalf of the Secretary of State, defending a challenge to locally controversial plans to build a waste incinerator on the Isle of Portland in Dorset.
The key issues concern:
- the standard of reasons to be provided by planning decision makers,
- the construction of relevant policies of the Waste Plan, and
- whether the decision maker fully considered whether the proposed development was appropriately located in accordance with the provisions of the Waste Plan.
