This involved High Court proceedings where part of a local authority’s Core Strategy was quashed where it contained a restriction on housing development in areas subjected to aircraft noise over 60 decibels.
The restriction cut across an existing structure plan policy and was more prescriptive than government planning policy guidance, which described limiting noise levels to 60 decibels as a desirable aim rather than a firm policy requirement.
