An LVT challenge to residential service charges relating to a development within Crossways in Kent. The primary issue (the subsidiary issues all relating to reasonableness) was one of construction of the Lease (and a Deed of covenant entered into by the Freeholder relating to Crossways) viz. whether service charges recovered from the freeholder for the maintenance of the wider estate (covering a large are of commercial and industrial use and an anticipated 30,000 homes) were recoverable from a the tenant of a small residential block therein.
