Challenge to wind farm decision awaiting judgment

In a rare joint challenge brought by East Northamptonshire District Council, English Heritage and the National Trust, the decision by an inspector to grant planning permission for a four-turbine wind farm near a number of important heritage assets is said to have been unlawful because of the approach taken by the inspector to the effect on the heritage assets’ settings.

The wind turbines would be seen in views of, and from, Lieveden New Bield and other grade I and grade II* listed buildings. The Secretary of State had consented to judgment but the developer contested the claim. Lang J has reserved judgment.
