Cornerstone Barristers in Supreme Court Planning Case

Jonathan Clay and Ashley Bowes will be appearing today and tomorrow for Suffolk Coastal District Council in the co-joined appeals of Suffolk Coastal DC v Hopkins Homes Ltd and Cheshire East DC v Richborough Estates Ltd with the Secretary of State for Communities and Local Government intervening.

The appeals concern the meaning of the phrase “policies for the supply of housing” as it appears at paragraph 49 NPPF, together with its interaction with the presumption in favour of sustainable development at paragraph 14 NPPF. It will be the first time the highest Court has considered the NPPF. The Court has also sought the parties’ views on the source of the Secretary of State’s power to formulate and adopt planning policy. The case is therefore set to have wide-ranging consequences.
