Court Hears Tesco’s Challenge Against Council’s Lidl Supermarket Decision

Today Ben Du Feu appeared in a judicial review concerning the grant of planning permission for a new supermarket. The claim was brought by Tesco. The proposed operator of the supermarket is Lidl. Ben acted for Reigate & Banstead Council. Members granted planning permission contrary to the recommendation in the officer’s report. The grounds of challenge concern the approach to s.66 of the Planning (Listed Buildings and Conservation Areas) Act 1990 and the standard of reasons required where members depart from the advice of their officers. Judgment was reserved.
