In this breakfast briefing, we will discuss the approach of the courts to legal challenges concerning the interpretation of planning policy. We will look at the ever-growing body of case law in the area relating to national and development plan policy and seek to identify some common themes.

This topic is particularly relevant given the publication of the NPPF2 which will no doubt be the subject of much litigation.

The briefing will cover some issues of interpretation which the courts are likely to have to grapple with soon and which practitioners may find of use in assessing planning policy at all levels now.
