Full costs award secured for Redrow Homes on appeal

Tom Cosgrove QC acted for the successful appellant, Redrow Homes, in securing a s.78 planning appeal decision and a full award of costs against the planning authority.

In the Decision dated 29 November 2019, a Planning Inspector allowed an appeal made by Redrow Homes against South Cambridgeshire District Council relating to a large scale residential development at the site of the former Barrington Cement Works, Haslingfield Road, Barrington, Cambridgeshire. In a separate Decision of the same date, the Inspector allowed an application for a full award of costs against the Council.

The Inspector accepted the written and oral submissions made on behalf of Redrow by Tom that the failure to effectively engage by the Council with Redrow had caused a lengthy and unreasonable delay. The Inspector agreed that Redrow had therefore been put to the expense of submitting an unnecessary appeal. Tom was instructed by Barker Parry Town Planning.
