Lisa acted for the LPA Second Respondent in an advisory capacity in two conjoined appeals under section 288 of the 1990 Act whereby the Claimant seeks to challenge the decision of an Inspector dismissing his appeal against the refusal of the LPA of prior approval for residential development. The proceedings involved an important point of interpretation of the GPDO, revisiting arguments recently dealt with by the Court in Warren Farm v Wokingham BC, with a view to persuading the Court to reach a different decision. The Respondents were successful in this, both at first instance and in the Court of Appeal.
