Today, Josef Cannon begins a planning inquiry into a proposal for 450 new homes at Fiddington, near Tewkesbury, against Paul Tucker QC and Philip Robson.

Joe represents the local planning authority in what is the first inquiry to deal with housing land supply in Tewkesbury after the High Court (Mr Justice Dove) ruled that it was a matter of planning judgment in each case whether to take account of past “oversupply” (advance delivery of houses against annual average requirements) since the start of a plan period, and that neither the NPPF or the PPG gave any assistance on how to address it.

The case also concerns the effect of these standalone proposals on the wider plans for a Garden Town in the area.
