Judge quashes wind farm permission in case brought by local authority, English Heritage and the National Trust.

In an important decision on the correct approach to development affecting heritage assets, Mrs Justice Lang has struck down the decision of a planning inspector allowing a wind farm within the settings of a number of Grade I and Grade II* listed buildings, including the nationally important Lieveden New Bield.

The judge accepted the claimants’ case that the inspector had misapplied the duty in s 66 of the Planning (Listed Buildings and Conservation Areas) Act 1990 and national policy on heritage assets.
