Residential Inquiry In Surrey – Site Not Sustainable Because Of Flood Risk [2014]

In a decision issued on the 25th June 2014 a planning inspector has dismissed an appeal by Charles Church Developments Ltd made under section 78 of the Town and Country Planning Act 1990. The appeal was made against the decision of Mole Valley District Council as the local planning authority to refuse permission for the erection of thirty residential dwellings including twelve affordable homes together with associated open space, meadow land, access, landscaping and seventy five parking places. In an indication of how seriously planning inspectors consider the issue of flooding to be the inspector held that, despite expert assurances that the proposed scheme would prevent flooding on and off site, in the absence of guarantees that the site would never suffer serious flooding he could not consider the site to be a sustainable one for residential development. Tom Cosgrove appeared for the local planning authority at the inquiry.
