On 7th February Mrs Justice Swift gave permission for a judicial review of the LB Richmond’s decision to decline to determine an application for planning permission under section 70A of the 1990 Act on pure Wednesbury grounds. She found it arguable that, while the same use had been refused permission by the Secretary of State, the differences in the proposal before them coupled with the additional evidence relied upon, made their decision irrational.
