Lisa acted for British Waterways (the predecessor organisation to the Canal and River Trust) in an appeal against refusal of planning permission for change of use of land for the stationing of two caravans and three touring caravans in the vicinity of Wilstone Reservoir in Hertfordshire, and appeal against an enforcement notice issued with respect to the same development.

The appeal was dismissed and enforcement notice upheld by an Inspector appointed by the Secretary of State on 5th January 2009 solely in the basis of British Waterway’s evidence to the effect that the establishment of a residential community in the vicinity of the reservoir would impose a disproportionately costly requirement upon it to maintain the Reservoir to a certain specified standard.

That decision was subsequently upheld on the travellers’ appeal to the High Court ([2009] EWHC 742 (QB).
