Ryan Kohli acted on behalf of the Secretary of State in defending a s. 289 challenge to the decision of a planning inspector to uphold an enforcement notice requiring the demolition of an unlawfully constructed dwelling on the green belt. The case concerned, inter alia, the adequacy of the inspector’s consideration of alternative schemes under Ground F and whether PD rights, once implemented under Class A, can survive the demolition of the dwellinghouse.
