Carumi Ltd. V London Borough Of Lambeth (July 2012)
This was an appeal against the Council’s decision to restrict the licensing hours at a nightclub known as Artesian Well – with a capacity of approximately 500 people – following a review brought by a group of local residents. The District Judge at Tower Bridge Magistrates’ Court considered expert noise evidence, police evidence of assaults and violence in and around the premises, as well as detailed evidence of serious public nuisance (anti-social behaviour relating to customers arriving and leaving the venue in the early hours of the morning) from residents and customers. The appeal was heard over a total of 3 days. The decision was to grant a slight extension on the hours imposed by the Council, but not those sought by the premises. No costs were ordered.
