FreeHomelessness appeals under section 204 of the Housing Act 1996 are a staple of housing law practice and litigation in which the County Court’s jurisdiction is, in the words of Lord Bingham in Runa Begum v Tower Hamlets LBC [2003] 2 A.C. 430 ยง7, “in substance the same as that of the High Court in judicial review”, and the role of the local housing authority akin to that of the Administrative Court respondent.
This webinar, aimed at local housing authorities, considers the role of the respondent authority and discusses top tips and tactics for an effective County Court response.
The presenters are Andy Lane and Dean Underwood of Cornerstone Barristers’ Public Law and Housing Teams. Andy and Dean are regularly instructed in homelessness appeals by local authorities nationwide, and have been involved in some of the leading authorities in the area, including Adesotu v Lewisham LBC [2019] 1 W.L.R. 5637 and Stanley v Welwyn Hatfield BC [2021] H.L.R. 12.
