The extension of the possession claim stay to 20th September 2020 has been controversial for many and varied reasons.  However, with the coming into force of The Coronavirus Act 2020 (Residential Tenancies: Protection from Eviction)(Amendment)(England) Regulations 2020/914 on Saturday, 29 August 2020 we have received the clearest indication yet that there will be no further extension of the stay.  Rather, the variation of the temporary possession notice provisions of Schedule 29 to the Coronavirus Act 2020 and the issuing of non-statutory guidance at the start of this week has finally provided the ‘road map’ as to how the Government intend to deal with the stay ending and possession claims progressing (and orders being enforced).

Andy Lane chaired this event in which, with other members of Cornerstone Barristers’ Housing and Public Law Teams, the appropriate notice to serve pre-issue of possession claim, the fate of existing claims, the operation of the county courts in practice and proper compliance with Practice Direction 55C were explained and discussed.
