Rowan Clapp begins a four-day planning inquiry concerning a proposal for 47 homes at Fleet Lane, Twyning, Tewkesbury.

Rowan represents the local planning authority in the appeal, which concerns how local authorities may consider past over delivery in the calculation of their present five-year housing land supply; one of the first cases to do so following the recent judgment of Dove J to the effect that this is a matter of planning judgment. The inquiry is also set to consider how allocations within emerging plans are to be taken into account in assessing the duration and extent of any present housing land supply shortfall.

The case also concerns heritage and landscape harm, as well as the weight to be afforded to conflict with local plan policies concerning spatial strategy where a five-year supply of land is not demonstrated.
