Kelvin Rutledge KC and Riccardo Calzavara appear at Supreme Court

Cornerstone’s Kelvin Rutledge KC and Riccardo Calzavara are in the Supreme Court over the next two days in the case of R (Imam) v Croydon LBC before Lords Lloyd-Jones, Sales, Hamblen, Leggatt, and Richards.
The issue before the Court relates to when a mandatory order should be made against a local housing authority to enforce a duty owed to a homeless applicant under s.193(2) Housing Act 1996. In particular, the Court will consider whether budgetary constraints and/or the availability of non-secure tenancies are relevant to its remedial discretion.
Kelvin and Riccardo represent the Appellant, Croydon London Borough Council, in an appeal against the decision of the Court of Appeal in R (Elkundi) v Birmingham CC. They are instructed by Victoria Searle of Browne Jacobson LLP.
