Section 78 appeal (inquiry) successfully defending Waverley BC’s refusal of outline planning permission for a 57 unit residential scheme within the village of Rudgwick.
The inquiry heard expert evidence on landscape & visual, heritage, housing land supply, and planning matters including locational sustainability. The appeal was dismissed notwithstanding that the Council could not demonstrate a 5yr HLS (3.9yrs).
Harm was identified through the erosion of the AGLV with the likely character of the scheme being at odds with the linear and dispersed pattern of housing nearby, to the settings of a Grade I listed Church, Grade II listed 18th century farmhouse, and to the Conservation Area, and inappropriate location of the appeal site though providing reasonable access to the village facilities and services.
