The decision in Hammersmith and Fulham LBC v Monk [1992] 1 A.C. 478, that at common law a periodic joint residential tenancy was terminated automatically served a notice to quit on the landlord, was not incompatible with the other joint tenant’s rights under ECHR Protocol 1 art.1 and art.8. A husband had no right to remain in a local authority property as a sole tenant after his wife had left and given notice to the local authority landlord quitting the joint tenancy.
