Miah and Ullah v Brentwood BC (The Raj, Brentwood)

21 Oct 2019

Licensing

Successfully defended (at appeal) Brentwood BC’s decision to revoke a premises licence for an Indian Restaurant, based on the employment of illegal workers, following an operation led by the Police. A number of appeals were conjoined in which the refusal of transfers of the premises licence, sought both before and after the revocation decision, were also appealed.

Having heard evidence from a number of witnesses, the Court upheld the revocation of the licence, referring to the illegal working (5 workers were identified) as amounting to modern day slavery. Whilst the Court indicated that the transfers should have been granted, legally they were of no effect.
