Supreme Court to hear homelessness challenge

R(CN) v Lewisham LBC and R(ZH) v Newham LBC have been listed to be heard by the Supreme Court in April. The Appellants seek to overturn Mohamed v Manek and RB Kensington and Chelsea, which established that local authorities do not need to obtain a court order to evict homeless applicants from interim accommodation.

The main issue is whether article 8, ECHR requires a possession order to be obtained to evict any occupier of a home – including temporary accommodation for the homeless.
