Whalley v Chesterfield BC
21 Jan 2019
Successfully represented Chesterfield BC in an appeal against its decision to revoke a Private Hire Driver’s Licence with immediate effect following an altercation outside a hospital between the driver and a security guard, in the context of a pattern of several other incidents.
The appeal considered the Council’s objective – written into its licensing policy – of promoting public confidence in the drivers it licenses by seeking the highest standards of driver conduct. This was balanced against the potential loss of the driver’s livelihood.
