Estelle Dehon KC named as The Times’ Lawyer of the Week for Cumbria coal mine challenge

Cornerstone’s Estelle Dehon KC has been named by The Times as Lawyer of the Week in recognition of the Secretary of State consenting to judgment in the legal challenge to permission for a metallurgical coal mine in Cumbria, which had been granted partly on the basis that it would have a “neutral effect” on climate change.

The result in Cumbria followed the Supreme Court’s judgment in the Finch litigation that set a precedent that planning authorities should account for “downstream emissions” of fossil fuel projects, which in recent weeks has also led to permission for an oil and gas drilling scheme in Biscathorpe, Lincolnshire being quashed. Estelle appeared in all three cases.
